• Acceptance of Terms

Welcome to Auction Tokyo (AT) and our deputing service on online auctions and online shops in Japan (service). AT provides its service to you subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time on this page.

• Definition

The following terms are defined as stated:

Member refers to the people that acknowledge the Terms and Conditions and have registered to become a AT's member.
Service� refers to the transaction service we provide for customers.
Sellers� refer to the Yahoo! JAPAN Auctions sellers and Japanese online shops.

• Member Registration

Use of the Site and Services is limited to parties that lawfully can enter into and form contracts under applicable law. For example, minors are not allowed to use the Services. To register, you must provide your real name, address, phone number, e-mail address, and maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or AT has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, AT has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

• User ID and Password Management

The user ID and password are to be safeguarded by users themselves and changed periodically for safety reasons. The user is deemed to be the person with the corresponding user ID if both the user ID and password are consistent with those registered and are verified by specified methods. We are not liable for loss sustained from fraudulent or illegal use of someone elses user ID or password.

• Changing of Your Information

Please log in to AT's member page and modify and change your information. AT does not have any responsible for changing your information. That is, you, customer must provide the accurate and true information when you changing the information.

• Membership cancellation

Please go to your member's page to cancel your membership.

• Disclaimer

1. We cannot guarantee the truthfulness, accuracy, usefulness, reliability, or legality of information about Sellers, the transaction conducted by Sellers, the products sold, the service and the information on the website as well as the personal information of the Sellers, or whether they infringe the rights of third parties.
2. In no event will we be liable to you or anyone else for any loss incurred by system interruption, delay, suspension or data loss, or loss caused by illegal data access, as well as any loss caused by other services provided by this
   website.
3. We do not guarantee that e-mails sent by or through our website, server or domain name are free of viruses.
4. We cannot be held responsible for any information or advice we provide to you.
5. We are not liable for the loss incurred by violation of these Terms and Conditions.
6. There may be country specific duties and taxes imposed on your bid that are not reflected in our prices. You are fully responsible for any tax and duties chargeable by your local government on goods purchased from us. Please check with your local customs office for further details.
7. We cannot be held responsible for any damage or stolen items during the shipping.
8. If the destination country requires an import license or other permit for import of the merchandise, it is your responsibility to obtain such a license or permit at your own expense.
9. We are not liable for any fraudulent activities related with our transaction. If the seller who does not send us the products even though we paid Successful bid price and etc , we normally does not charge our commission for this case to member. But member should bear and pay all invoiced charge plus transaction fee 6%.

• Prohibitions

When using AT's service, the following is prohibited:

Violation of laws and regulations, these Terms and Conditions, or Cautionary Notes;Infringement of our rights, good name, or of the Sellers or any third party; Actions that could cause harm to the body and mind of adolescents or violate morals;Actions impeding other users or any third party or actions that are offensive;Relay of false information;Sending or writing harmful programs or e-mails;Illegally breaking into our server or other computers; Lending or transferring user IDs or passwords to others or using these for third parties.

• Links

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because AT has no control over such sites and resources, you acknowledge and agree that AT is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that AT shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

• Cookies

We need to collect cookies to authenticate users of this website as members, investigate members access and usage records, provide better service to members we need to collect the following: information about IP addresses where users access our server, the cell phone IDs of the members who use a cell phone for access, as well as the online record of members collected by using cookies.

• Our Service

1. Members must pay for domestic shipping, overseas shipping, our service fee, bank transaction fee, tariffs, and other charges.
2. On AUCTION SERVICE, Cancellation after successful bids have not been accepted. Also, returns and claims after successful bid shall not be accepted.
3. On ONLINE SHOP SERVICE, Cancellation after purchasing on any online shop has not been accepted. Also, returns and claims after AT has purchased by proxy on online-shops shall not be accepted.
4. On AT SHIPPING SERVICE, you acknowledge that we have an disposed authority of the item if the item has arrived without order.
5. On TEMPORARY STORAGE SERVICE, you acknowledge that the Storage Period is for 3 months. When the storage period of 3 months has passed from the arrival date, we have the authority to dispose of your item. In addition, we cannot compensate your item for the storage.

• Service Modification and Discontinuance

AT reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that AT shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

• Article Modification

We have the right to amend these Terms and Conditions at will. In addition, we can add complementary terms and conditions (hereinafter referred to as complements�). Amendments to these Terms and Conditions and complements shall take effect as indicated on the website. Members must abide by the new Terms and Conditions

• Payment

We accepts payment in Japanese yen by VISA, Master Card, American Express, and JCB card. We cannot accept cash, cheques, credit vouchers, gift certificates or other credit cards. Also, We only accept lump-sum payments. We cannot accept payment by monthly installment or any installments.

• Shipping

Domestic Shipping (Shipping inside Japan);

1. We cannot answer the period of the domestic shipping. We shall announce the item arrival on member's page.
2. On AUCTION SERVICE & ONLINE SHOP SERVICE, a uniform of 1,000yen is charged as domestic shipping fee. Also, we shall charge an extra dostic shipping fee when you pay the international shipping fee if the domestic shipping fee exceeds 1,000yen. Intenational Shipping;You acknowledge that we cannot compensate the damage, stolen, lost on international shipping.

• Privacy Policy

The Privacy Notice may be changed by us in the future. You should check the Privacy Notice frequently for changes.

• AT's Proprietary Rights

You acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or by advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by AT or advertisers, you agree not to modify, rent,
lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

AT grants you a personal, non-transferable and non-exclusive right and license to use the object code of its Software on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, nor to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by AT for use in accessing the Service.

• Notice

AT may provide you with notices, including those regarding changes to the TOS, by email, regular mail or postings on the Service.

• Notice and Procedure for Making Claims of Copyrights or Intellectual Property Infringement.

AT respects the intellectual property of others, and we ask our users to do the same. AT may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide AT's Copyright Agent the following information:

1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
2. a description of the copyrighted work or other intellectual property that you claim has been infringed;
3. a description of where the material that you claim is infringing is located on the site;
4. your address, telephone number, and email address;
